Terms
These terms apply when you buy a plan from HND Hosting, a service of Hooknot Digital, run by Rohin Grover in India. By ordering, you agree to them. If anything here is unclear, email [email protected] before you order.
1. What you buy
Each plan is a server of your own, rented by us from Contabo GmbH in the location you choose, with Moodle or IOMAD installed and looked after by us. What each plan includes, and what costs extra, is listed on our prices page at the time you order. You get full Moodle administrator access. We keep the server's root login, because we are responsible for keeping the server secure and up to date.
2. Orders and setup
- A person checks every order before we set it up. We may decline an order, for example when we cannot serve the country it comes from, and then refund it in full.
- We aim to have a new site ready within 2 working days of payment, India time. A move from another host can take longer, because it depends on when we receive your site's export.
- You need a domain of your own if you want the site on it. You point it at the server; we tell you exactly what to set.
- Business customers in the European Union and the United Kingdom need a valid VAT number to order online.
3. Prices and payment
- Prices are in US dollars and paid in advance by PayPal, for a month, 6 months or 12 months.
- Monthly plans have a one-time setup fee of $275. It is free when you pay for 6 or 12 months.
- Your plan renews at the end of each period. If you set up automatic payment, PayPal pays each renewal. Otherwise we send an invoice before the renewal date.
- We may change our prices. A change never affects a period you have already paid for, and we tell you at least 30 days before it applies to your plan.
- If an invoice is still unpaid 14 days after its due date, we may suspend your site. We tell you before we do.
4. Cancelling and refunds
- You can cancel at any time by emailing us or from the client area. Your site keeps running until the end of the period you have paid for.
- If you cancel before we start setting up your site, we refund everything you paid.
- Once setup has started, the setup fee and the current month are not refunded, because the server and the work have already been paid for on your behalf.
- If you cancel a 6 or 12-month plan early, we refund the full months you have not used, less $275 for the setup fee you did not pay.
- Before your plan ends, ask us for a full copy of your site and we will send a download link. We delete your site and its backups 30 days after your plan ends.
5. Backups and restores
We back up your site every day and keep recent copies on the server and an encrypted copy off it. If something goes wrong on our side, we restore your site at no charge. If you need something restored because of a change made on your site, such as a deleted course, we do it as paid work at $25 an hour. Backups protect against accidents. They are not a replacement for you keeping your own copy of anything you cannot afford to lose.
6. What we look after, and what you look after
- We look after the server, its security updates, the web server, PHP and database, Moodle's security and minor updates for your version, SSL, email sending through the address you give us, monitoring and backups.
- You look after your site's content, users, courses and settings, which plugins and themes you ask for, and your domain. Help inside Moodle is paid work at the prices on our prices page, and we tell you the price before we start.
- Moving to a newer Moodle version is a version upgrade, priced on our prices page.
7. Acceptable use
Your site must be used for learning and training. You may not use it to store or send anything illegal, to send spam, to host malware or phishing, to mine cryptocurrency, to attack other systems, or in any way that breaks Contabo's terms for the server. If your site is used like this, or if Contabo suspends the server because of it, we may suspend your site straight away, and we tell you why.
8. Your data
The learner and course data on your site is yours. We handle it only to run and look after your site, on your instructions, and we do not use it for anything else. Our privacy page lists the companies that help us run the service. Business customers who need a data processing agreement can ask us for one.
9. Availability
We work to keep your site running and fix problems on our side as quickly as we can. We do not promise a particular uptime figure. Planned work that takes your site offline is done at a quiet time, and we tell you in advance.
10. Liability
We are responsible for doing our work with reasonable care and skill. If something goes wrong because of us, our total liability to you is limited to what you paid us in the 12 months before it happened. We are not liable for indirect losses, such as lost profits or lost business. Nothing in these terms limits liability that the law does not allow to be limited.
11. Moodle
Moodle™ is a trademark of Moodle Pty Ltd. HND Hosting is independent and is not affiliated with, endorsed by or certified by Moodle Pty Ltd. Moodle and IOMAD are open-source software, and their licences apply to them.
12. Changes and the law
If we change these terms, we update this page and its date, and email you about any change that affects your plan at least 30 days before it applies. These terms are governed by the laws of India, and the courts of Lucknow, Uttar Pradesh, have jurisdiction.
